EFINITY ECOM – TERMS OF SERVICE
1. ACCEPTANCE OF TERMS
You agree that by accessing the Site https://www.efinityecom.com/, you have read, understood, and agree to be
bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly
prohibited from using the Site and you must discontinue use immediately.
Supplemental Terms of Service or documents that may be posted on the Site from time to time are hereby expressly
incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to
these Terms of Service at any time and for any reason.
2. INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality,
software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and
the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to
us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair
competition laws of the United States, foreign jurisdictions, and international conventions.
The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. Except as
expressly provided in these Terms of Service, no part of the Site and no Content or Marks may be copied,
reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted,
distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior
written permission.
Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to
download or print a copy of any portion of the Content to which you have properly gained access solely for your
personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the Content and
the Marks.
3. EARNINGS AND INCOME DISCLAIMER
Every effort has been made to accurately represent the Resource Referrals Service and its potential. CLIENT
expressly acknowledges that Efinity eCom’s doesn’t take liability of any service disruption or events beyond our
control that could adversely affect the Efinity eCom services. Such disruptions or events, include, but are not limited
to: Social Media restrictions, system delays or outages; power outages; network, communication or data plan
outages; natural disasters; or any other event outside the control of us. Any such disruption or event may block or
otherwise limit your usage of the Advertising platforms services and/or use of your online store settings in place at the
time of the disruptions. You agree that we will not be liable for any losses or damages as a result of Service
unavailability. Efinity eCom will be liable and honor the clause nine (9) our Money back Guarantee of ninety (90) days
refund policy. Client acknowledge that past this period of time we don’t offer a full-refund policy.
4. REFUND POLICY
Efinity eCom Refund Policy will be honored as stated on “Exhibit A” and Refund Policy also found on our website.
Client can apply to receive a full refund in the following scenarios:
(i) Services provided to the client are non performing or underperforming. Only if Efinity eCom hasn’t been able to
generate $10k in gross sales within 90 days of advertising.
(ii) Client’s Ads Account has not been under any restriction or experiencing issues with Third Party Media Platform
during the 90 days.
(iii) The Ads account balance has been paid on time and there are no billing issues with the Social Media accounts
during the 90 days period.
5. SUBSCRIPTION AGREEMENT
Your Marketer Growth membership will continue month-to-month unless and until you cancel your membership or we
terminate it.Payment for the subscription fees will be processed with the same payment method used to process the
initial set up transaction hereunder shall be made by the Client. Client agrees on processing the payment only with
cards under their legal name. Client agrees that Efinity eCom may store and use the information Client provides for
use in maintaining and billing fees to Client. Client agrees on processing the payments on time and understands that
any delays with the transactions might negatively impact their account.
5.2 For subscription cancellations, you must state your cancellation via email contact@efinityecom.com or via the
Skype group chat with a minimum of 48 hours prior to your subscription renewal.
6.THIRD PARTY PLATFORMS
Certain Services require Client to grant access to Efinity eCom as partnered access. Such software/platforms/ apps
which in some situations Client will have to download, execute and install the applicable Software/platforms/apps
onto Client’s end user’s computer, laptop or mobile device (as applicable) for which Client will grant partnered access
to Efinity eCom Agency. Client shall not alter, distribute, reproduce, create derivatives of, edit, disassemble or reverse
any action processed by Efinity eCom Agency meanwhile the service is being rendered.. Efinity eCom makes no
other representation or warranty with respect to the third party Software/Platform/Apps used to provide our service
Efinity eCom is not responsible or liable for (a) changes or modifications made to the Software/Platform/Apps by
anyone other than Efinity eCom; or (b) any changes, modifications, restrictions placed by the third party platform or
issues on or arising from Client’s systems, servers, networks, or the Internet which affects the use or operation of the
Software. Where Client licenses software/platform/Apps directly from the licensor of such software/platform/Apps,
Client must contact the licensor support for any issues related to the third party service.
7. PRIVACY POLICY
We care about data privacy and security. Please review our Privacy Policy posted on the Site. By using the Site, you
agree to be bound by our Privacy Policy, which is incorporated into these Terms of Service.
8. TERM AND TERMINATION
These Terms of Service shall remain in full force and effect while you use the Site. WITHOUT LIMITING ANY OTHER
PROVISION OF THESE TERMS OF SERVICE, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION DENY ACCESS
TO AND USE OF THE SITE (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR
FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR
COVENANT CONTAINED IN THESE TERMS OF SERVICE OR OF ANY APPLICABLE LAW OR REGULATION.
If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new
account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on
behalf of the third party.
In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including
without limitation pursuing civil, criminal, and injunctive redress.
9. MODIFICATIONS AND INTERRUPTIONS
We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole
discretion without notice. However, we have no obligation to update any information on our Site. We also reserve the
right to modify or discontinue all or part of the Site without notice at any time.
We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the
Site.
We cannot guarantee the Site will be available at all times. We may experience hardware, software, or other problems
or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors.
We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Site at any time or for
any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or
inconvenience caused by your inability to access or use the Site during any downtime or discontinuance of the Site.
Nothing in these Terms of Service will be construed to obligate us to maintain and support the Site or to supply any
corrections, updates, or releases in connection therewith
